France-Algeria: New Measures Taken for Immigrants Threatened With Expulsion

Labor Minister Olivier Dussopt and Interior Minister Gérald Darmanin want to include a clause for undocumented workers in the new “immigration” bill. The aim is to create a “short-term occupations” residence permit. Various measures will also be put in place to reconsider deportations to the border.

Measures concerning foreigners who receive an OQTF

Foreign nationals who receive an OQTF or obligation to leave the territory can appeal to benefit from a suspension. If previously there were 12 categories of appeal , in the new “immigration” bill in 2023, there should only be 4.

Thus the procedures will be simplified and will be executed more quickly. It is also important to know the exact rate of execution because only the rates of assisted departures and forced departures are observed.

Thousands of people receiving an OQTF leave the territory without there being any trace anywhere. In order for this data to be known, these individuals will now be on the wanted file so that they can be flagged when they leave.

Facilitating the integration of foreign workers

Foreigners applying for asylum will now be able to work during their first 6 months in France. A “shortage job” residence permit should also be established next year to compensate for the shortage of labor in certain sectors.

Foreigners who have never exhibited reprehensible behavior and without a criminal record will automatically benefit from a renewal of their residence permit. On the other hand, foreigners who arrive before the age of 13 in France and who are in an irregular situation can also leave the territory according to the decision of the judge. Previously, there was an impediment to removal which concerned these people.
